Accepting these terms

These Terms of Use (the “Terms”) apply to the VocabNext mobile applications, website, and related services (together, the “Service”). By accessing or using the Service, you enter into an agreement with LZ Studio, which operates VocabNext, and confirm that you can legally agree to these Terms.

If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. They must review and agree to these Terms on your behalf.

The VocabNext service

VocabNext helps you discover, learn, and review English vocabulary. Features may include word lists, definitions, translations, examples, images, audio, progress tracking, reminders, and cloud backup.

The Service is a learning aid, not a testing authority, accredited course, or guarantee of fluency, exam results, or any other particular outcome. Language can be nuanced, and learning content may occasionally be incomplete, simplified, or incorrect. Please use your own judgement and let us know if something needs attention.

Your account

Some features work without a registered account, while others may require you to sign in. You are responsible for providing accurate account information, keeping your sign-in method secure, and promptly telling us if you believe your account has been used without permission.

You are responsible for activity performed through your account. You may not impersonate another person, create an account for someone without permission, or transfer your account in a way that compromises its security. You can delete your account through Account and Settings in the mobile app.

Using VocabNext responsibly

We give you a personal, limited, non-exclusive, non-transferable, and revocable right to use the Service for lawful, non-commercial learning purposes.

When using the Service, you must not:

• break the law, infringe another person’s rights, or encourage harmful activity;
• interfere with the Service, its security, or another person’s use of it;
• use automated means to scrape, copy, harvest, or overload the Service;
• reverse engineer, bypass, or attempt to defeat access or usage restrictions, except where the law expressly allows it;
• upload malicious code or content that is unlawful, abusive, deceptive, or invasive of privacy; or
• resell, sublicense, or commercially exploit the Service or its content without our written permission.

Content and ownership

The Service—including its software, design, branding, text, learning material, illustrations, audio, and other content—is owned by VocabNext or its licensors and is protected by intellectual-property laws. These Terms do not transfer ownership of the Service or its content to you.

You keep ownership of content you submit, such as feedback messages and attachments. You give us permission to host, store, reproduce, and use that content only as reasonably needed to operate, secure, support, and improve the Service. You confirm that you have the rights needed to submit it.

If you send us ideas or suggestions, we may use them without restriction or compensation to you. Please do not send material you consider confidential.

Paid services and subscriptions

VocabNext Premium is available through auto-renewable subscriptions purchased through Apple’s App Store. Monthly, three-month, and annual plans provide the same Premium service for different billing periods. Available plans, features, prices, currencies, and offers may vary by storefront. Before confirmation, the purchase screen shows the subscription, billing period, localized recurring price, included features, and any introductory offer for which the current App Store account is eligible.

If Apple confirms that you qualify for a free trial, you will not be charged during the displayed trial period. Unless you cancel before it ends, the trial converts to the selected paid plan and Apple charges your App Store account. If no trial applies, Apple charges your account when you confirm the purchase. Introductory-offer eligibility is determined by Apple and is not guaranteed.

Subscriptions renew automatically for the selected billing period unless you cancel before the current period ends. Apple processes payments and handles subscription management, price-change notices or consent, cancellations, and refund requests under its terms. VocabNext does not receive your payment-card details. Cancelling stops future renewals; Premium normally remains available until the end of the paid period, but access may end earlier following a refund, revocation, fraud determination, or other action authorised by law or Apple’s rules.

A recoverable VocabNext account is required to purchase Premium. We use a pseudonymous app-account token to associate the verified App Store subscription with that account and make Premium available on your supported devices. A subscription may be associated with only one active VocabNext account at a time. The in-app restore process can verify an eligible purchase and recover access.

Deleting your VocabNext account does not cancel an App Store subscription or stop Apple from billing it. Manage or cancel the subscription with Apple before deleting your account. Account deletion detaches the subscription from your VocabNext identity, but Apple’s billing history and limited transaction records may be retained as explained in our Privacy Policy.

Third-party services

Parts of VocabNext may rely on or link to third-party services, such as app stores, sign-in providers, hosting platforms, and external content services. Their own terms and privacy practices apply when you use them. We do not control and are not responsible for third-party services, although we remain responsible for our own obligations under applicable law.

Availability and changes

We work to keep VocabNext useful and reliable, but the Service may sometimes be interrupted for maintenance, security, technical issues, or reasons outside our control. We may add, change, or remove features and content as the Service evolves.

We will provide the Premium service marketed at purchase throughout the paid subscription period. If a material paid feature becomes unavailable, any remedies available under applicable consumer law or the App Store’s rules, including any right to request a refund, remain unaffected.

We may also update these Terms. If a change is material, we will provide notice where reasonably possible and update the effective date above. Continued use after the new Terms take effect means you accept them. If you do not agree with an update, you should stop using the Service.

Ending your use

You may stop using VocabNext at any time. You may also delete your account using the available in-app process. Account deletion does not cancel a subscription; cancellation must be completed separately through Apple.

We may suspend or end access if you seriously or repeatedly breach these Terms, create risk or harm for VocabNext or others, or if we are legally required to do so. Where appropriate, we will try to give you notice and a reasonable chance to resolve the issue. Provisions that by their nature should continue—including ownership, disclaimers, and liability limits—remain in effect after termination.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not promise that it will always be available, secure, or error-free, or that every piece of learning content will be accurate or suitable for your particular needs.

Nothing in these Terms excludes warranties, consumer guarantees, or other rights that cannot lawfully be excluded or limited where you live.

Limits on liability

To the fullest extent permitted by law, VocabNext will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, data, goodwill, or business opportunity arising from your use of the Service.

Where liability cannot be excluded, our total liability arising from the Service or these Terms will be limited to the greater of the amount you paid VocabNext in the 12 months before the event giving rise to the claim or US$50. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

General terms

These Terms, together with any additional terms presented for a particular feature, form the agreement between you and VocabNext about the Service. Our Privacy Policy explains how we handle personal information.

For an application obtained through Apple’s App Store, Apple’s Standard End User License Agreement also applies to the licence for the application. These Terms govern the VocabNext account, learning service, and Premium subscription to the extent they do not conflict with that agreement or mandatory law.

If any part of these Terms is found unenforceable, the remaining terms stay in effect. If we do not enforce a provision immediately, that does not waive our right to enforce it later. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganisation, or sale of the Service.

Applicable law governs these Terms. Nothing here limits any mandatory consumer protection or right to bring a claim in a court available to you under the laws where you live.
